This Client Service Agreement (“Agreement”) is entered into between Blue Umbrella Travel, a travel agency located in South Dakota (“the Company”), and the client (“Client”) engaging the services of the Company.

Services: The Company agrees to provide travel planning, booking, and advisory services to the Client for their upcoming travel arrangements. These services may include but are not limited to hotel reservations, car rentals, cruise bookings, and tours.

Client Responsibilities: The Client agrees to provide accurate and up-to-date information regarding travel preferences, including travel dates, destination preferences, budget constraints, and any special requirements. The Client must abide by the terms and conditions of airlines, hotels, car rental companies, and other service providers. The Client is also responsible for promptly reviewing and confirming travel itineraries and providing feedback or approval as necessary.

Booking and Payments: All bookings made through the Company are subject to availability and confirmation by the respective service providers. The Client agrees to pay a deposit or full payment, as specified by the Company, to secure their bookings. Payment terms and cancellation policies vary depending on the type of service booked and will be communicated to the Client by the Company.

Cancellation and Refunds: Cancellation policies vary depending on the terms and conditions of the service providers. The Client may be entitled to a refund or credit, subject to the cancellation policies of the respective service providers and any applicable fees charged by the Company.

Travel Insurance: The Company strongly recommends that the Client purchase travel insurance to protect against unforeseen circumstances, including trip cancellations, medical emergencies, and travel disruptions. The Client is responsible for understanding the coverage and limitations of their travel insurance policy.

Liability: The Company acts as an intermediary between the Client and service providers and does not assume any liability for the acts, errors, omissions, or negligence of third-party service providers. The Client acknowledges that travel involves inherent risks, and the Company is not liable for any personal injury, property damage, or other losses incurred during travel.

Privacy Policy: The Company respects the privacy of its clients and complies with applicable data protection laws. Client information provided to the Company will be used solely for the purpose of facilitating travel bookings and will not be shared with third parties without consent.

Governing Law: This Agreement is governed by the laws of the state of South Dakota. Any disputes arising out of or relating to this Agreement shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.

I, The Client, hereby release and discharge Blue Umbrella Travel LLC, a travel agency located in South Dakota state (“the Company”), its officers, directors, employees, agents, and representatives, from any and all liability, claims, demands, actions, and causes of action arising out of or related to my participation in any travel arrangements or activities arranged by the Company.

I understand and acknowledge that travel involves certain inherent risks and hazards, including but not limited to accidents, injuries, illness, property damage, and loss. I voluntarily assume all risks associated with travel, including those risks that may arise from the negligence or fault of the Company or its agents.

I agree to indemnify and hold harmless the Company, its officers, directors, employees, agents, and representatives, from any and all liability, claims, demands, actions, and causes of action arising out of or related to my participation in any travel arrangements or activities arranged by the Company.

I understand that this release of liability is a legally binding contract and that I am giving up certain legal rights by signing it. I have read and fully understand the terms of this release of liability, and I voluntarily agree to be bound by its terms.

The recommendations and opinions in this itinerary are for your consideration. You may choose to follow or ignore the itinerary at your own risk. By purchasing a itinerary, you agree to release Blue Umbrella Travel from any responsibility for issues such as booking errors, accidents, injuries, cancellations, unsatisfactory experiences, financial loss, misinformation, missing information, and/or scams. Blue Umbrella Travel does not handle bookings or reservations and is not liable for any related issues. Additionally, Blue Umbrella Travel is not responsible for ensuring you have the necessary travel documents for your trip. Any consequences arising from not conducting your own comprehensive research are at your own risk.
